One year of the APER law: France stalls on its way to accelerating renewable energies


France Renouvelables has published its first assessment of the implementation of the APER Law, one year after its enactment in March 2023. The implementation of law no. 2023-175 of 10 March 2023, which aims to accelerate the production of renewable energy in France, is in a process of development that has generated expectations and challenges. So far, only 31% of the regulatory measures provided for by the law have been implemented, according to a report published by MPs M. Alfandari, M. Bothorel and M. Laisney in early February.

The APER law was the subject of a parliamentary report last month, providing an initial assessment of its implementation. The report highlights the measures that have already been carried out and those that are yet to be implemented, and stresses the need to evaluate the measures taken to date to ensure that they are aligned with the original objectives of the legislation. Despite the low implementation rate, both parliamentarians and the association "France renouvelables" point out that the delay is due to active collaboration with relevant stakeholders to ensure the correct implementation of the complex provisions.

In the report, France Renouvelables expresses its concern about the low implementation rate, attributing it to the desire of the ministerial services to jointly build the new rules with the actors directly concerned. Although this approach can be complex and has led to a lengthy process, the organisation considers it to be virtuous in achieving the initial objectives of the law: reducing implementation times, improving the acceptability of projects and institutionalising the principles and mechanisms of value sharing.

In its ongoing engagement, France Renouvelables highlights the importance of 14 provisions in which it is involved. These provisions are crucial both for renewable electricity developers and producers and for public or private consumers interested in purchasing renewable electricity. Among the various decrees, orders and legal measures listed, four are considered essential for the development of renewable energy projects in France:

1. Guarantee fund: France Renouvelables advocates the creation of a mandatory guarantee fund for all projects, despite ministerial concerns, and proposes conditions for its proper functioning.

2. Supply authorisation for PPAs: France Renouvelables identifies risks in the draft decree related to supply authorisation for PPA contracts, calling for adjustments to avoid restrictions on the signing of CPPAs.

3. Acceleration zones in tenders: The implementation of scoring criteria and variable tariffs according to the location of the project is crucial for France Renouvelables, seeking a rapid application throughout the country.

4. Participation in local development: The law provides for the financial contribution of renewable energy operators to local projects. France Renouvelables proposes adjustments to differentiate the contribution according to technology and ensure proper monitoring.

Despite the challenges, France Renouvelables shows its readiness to work with the ministries to overcome obstacles and advance the implementation of the law. The date of full implementation of the measures remains unknown, but it is hoped that the discussions and adjustments will contribute to the success of the transition to renewable energy in France.
